Letter from Sir Malachy J. Kelly to James Brown, 23 March 1916
1
DUBLIN CASTLE 23rd March 1916
Elizabeth Hogg decd. Dear Sir, I submitted your letter and copy affidavit of John Duff
to the Attorney General for his directions. It appears by the affidavit that Dr McIvor was present when
the alleged delivery of the Deposit Receipt was made to Mr John
Duff. As the validity of a donatio mortis causa depends upon what exactly took place at the time of the gift — & the circumstances under which it was made, The physical & mental condition of the donor & whether she contemplated immediate death The Attorney General would be glad to receive from Dr McIvor
a statement of what occurred on the occasion and I have written to
him accordingly I should be glad if you could get one from him & send it to me as soon as convenient. Yours truly, James Browne Esq Solicitor, Broad Street,
Magherafelt.
