It appears by the affidavit that Dr McIvor was present whenthe alleged delivery of the Deposit Receipt was made to Mr JohnDuff. As the validity of a donatio mortis causa depends upon what exactly took place at the time of the gift — & the circumstances under which it was made, The physical & mental condition of the donor & whether she contemplated immediate death The Attorney General would be glad to receive from Dr McIvora statement of what occurred on the occasion and I have written tohim accordingly I should be glad if you could get one from him & send it to me as soon as convenient.
