Letter from Malachy J. Kelly to James Brown, 23 March 1916
1
23rd March 1916
Elizabeth Hogg decd. Dear Sir, I submitted your letter and copy affidavit of John
Duff to the Attorney General for his directions. It appears by the affidavit that Dr McIver was present
when the alleged delivery of the Deposit Receipt was made to
Mr John Duff. As the validity of a donatio mortis causa depends upon
what exactly took place a the time of the gift and the circum-
stances under which it was made, the physical and mental con-
dition of the donor, and whether she contemplated immediate
death the Attorney General would be glad to receive from Dr.
McIver a statement of what occurred on the occasion and I shall
be glad if you get one from him and send it to me as soon as convenient. Yours truly, M Kelly James Browne Esq., Solicitor, Broad Street, Magherafelt.
