             CHIEF SECRETARY'S<lb/>10586 —  22.JUN.1916 <lb/>OFFICE   Under Secretary,   Please see Mr Magills draft reply<lb/>to Mr Whites question No.38 for tomorrow.  Mr Clary MP wrote to you on the 18th May<lb/>suggesting that a clause be inserted providing that<lb/>neither the unrepealed portions of the Whiteby Code<lb/>nor the Criminal <seg type="unclear"/>   code shall be applicable to cases<lb/>arising out of the rebellion. In reply to him on<lb/>the 20th item you said, as to the question of claims<lb/>for malicious compensation it is proposed to put a<lb/>clause in the Bill making this quite clear and I am<lb/>obliged to you for making the suggestion.   It is understood that many cases of the kind in<lb/>question are pending before the Recorder of Dublin.<lb/><!-- initials -->  21/6    Reply that I agree to draft reply<lb/>&amp; telegraph what A.G says<lb/>RC   21/6/16     Also<lb/>Telegraph to Mr Magill<lb/>what Clary said &amp; what I replied,<lb/>with dates. The Home <sic>Secy</sic> has<lb/>not yet decided   to sub section<lb/>six of the draft bill. I think we<lb/>must fire a non committal<lb/>answer &amp; suggest following for<lb/>Under <sic>Secy's</sic>Consideration (begins)<lb/>'The question referred to by the Hon<lb/>Member is under Consideration in<lb/>connection with the legislation which<lb/>the Govt hope to introduce dealing<lb/>with Considerations which have arisen<lb/>out of the recent disturbances in Ireland'<lb/>(ends).
